Colonial ships

60 tons.

(3.) Evory Colonial ship, not exceeling 60 tons, trading not exceeding or plying for hire stall, when leaving the waters of the Colony, be provided with officers who possess valid Certifi- cates of Competency according to the following seale;~~~

(a.) The master must possess a certificate appropriato to the grade of second mate, or of a higher grade. (6.) The engineer (in the case of a steam-ship) must possese & ccrtificate appropriate in the grade of second class engineer, or of a higher grade.

Sub-section (3) is new, and the object of it is to provide for Colonial ships, not exceeding 60 tons, having competent officers.

With regard to the following marginal query by the Board of Trade on sub- section (3) of section 4 of Ordinance 36 of 1899:-

"Leaving the waters. Why is the language altered from 'leaving any port in

the Colony' in sub-clause 2 above?"

I may mention that the reason for the alteration is that it is desired not to put registered steam launches at a disadvantage as compared with craft of the same descrip- tion which are not registered.

4 (3). If the words in this clause "when leaving the waters of the Colony" are to stand, should not a penalty be imposed in 4 (4) on a Colonial ship not exceeding 60 tons trading or plving for hire which leaves or attempts to leave the waters of the Colony without Officers having the requisite certificate?

The penalty in sub-section of this section is limited to the case of vessels leaving or attempting to leave any port.
